You shall not sell WayToCredit’s Services, information, or software associated with or derived from it or use any robot, spider, other automatic devices, or manual process to monitor or copy the Website and or it’s content or interfere or disrupt the Website; take any action that imposes an unreasonably or disproportionately large load on WayToCredit’s infrastructure/network or use any device, or interfere or attempt to interfere with the WayToCredit Services or forge headers or manipulate identifiers or other data to disguise the origin of any content transmitted through WayToCredit or to manipulate your presence on the Website.
You are restricted to post or transmit any kind of content through this Website. (You shall be solely liable for any damages resulting from any violation of the foregoing restrictions, or any other harm resulting from your posting of content to this Website)
You can use the Website to search for and to apply for loans, mutual funds, credit cards or other financial products.
You shall not use the Website to make a fraudulent application for any products listed on the Website.
If you use the website for any unlawful/illegal purpose, at our exclusive discretion, at any time and without advance notice or liability, suspend, terminate or restrict your access to all or any component of the Website.

4. OUR PARTNERS

WayToCredit doesn’t suggest any approval/ recommendation/ sponsorship/ opinion/ advice for the display of loan, mutual funds, credit card or other financial products, offered by third parties or their products. Neither it is in favor/against those third parties. Your interaction with any third party accessed through the Website is at your own risk. WayToCredit shall not be held liable for any delay, rejection or approval of any application made through its Website.

You agree and acknowledge that the credit shall be at the exclusive discretion of WayToCredit’s financial partners (lenders, credit card companies, mutual fund companies) while making an application through the Website for a financial product offered by such financial partners;

5. DISCLAIMER OF WARRANTY

WayToCredit provides all content and Services on the Website on an “as is” and “as available” basis. WayToCredit explicitly disclaims,

all warranties of any kind,
whether express or implied, including, but not limited to,
the implied warranties of merchantability,
fitness for a particular purpose,
non-infringement, and security and accuracy, as well as
all warranties arising by usage of trade, course of dealing, or course of performance.

WayToCredit makes no warranty, and explicitly disclaims any obligation, that:

(a) the content will be up-to-date, complete, comprehensive, accurate or applicable to your circumstances;

(b) The Website will meet your requirements or will be available on an uninterrupted, timely, secure, or error-free basis;

6. LIMITATION OF LIABILITY

WayToCredit (counting its officers, directors, employees, representatives, affiliates, and providers) will not be responsible or liable for,

(a) any injury, death, loss, claim, act of God, accident, delay, or any direct, special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including without limitation lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, that arise out of or is in any way connected with (1) any failure or delay (including without limitation the use of or inability to use any component of the Website), or (2) any use of the Website or content, or (3) the performance or non-performance by us or any provider, even if we have been advised of the possibility of damages to such parties or any other party.
(b) any damages to or viruses that may infect your computer equipment or other property as the result of your access to the Website or your downloading of any content from the Website. However, since WayToCredit has no control over such third-party websites, you acknowledge and agree that WayToCredit is not responsible for the availability of such third-party websites and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such third-party websites. You further acknowledge and agree that WayToCredit shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party websites.

7. Inevitable Incidences

Sometimes obstacles or unpredictable incidences may occur,

acts of God, lightning, severe weather, natural calamities like flood/earthquakes, war, revolution, shortages of materials, rationing, inducement of any virus, malware, other disruptive mechanisms, utility or communication failures,
acts of terrorism, civil commotion, acts of public enemies, labour disputes, strikes, any event of hacking or illegal usage of the Website, blockade, embargo or any law, order, proclamation, regulation, ordinance, demand or requirement having legal effect of any government which is beyond the control of WayToCredit;

In such cases, if the production of Services/Website by WayToCredit is prevented, restricted, delayed or interfered then WayToCredit shall be excused.

credit cards or other financial products that you may apply on the Website.

The laws of India, without regard to its conflict of laws rules, will govern these Terms, as well as your and our observance of the same. If you take any legal action relating to your use of the Website or these Terms, you agree to file such action only in the courts located in Chennai, India. In any such action that we may initiate, the prevailing party will be entitled to recover all legal expenses incurred in connection with the legal action, including but not limited to costs, both taxable and non-taxable, and reasonable attorney fees.

You may not assign or otherwise transfer your rights or obligations under these Terms. WayToCredit may assign its rights and duties under these Terms without any such assignment being considered a change to the Terms and without any notice to you. You acknowledge that you have read and have understood these Terms and that these Terms have the same force and effect as a signed agreement.

1.INTRODUCTION:

(i) This Policy applies our bank sharing in the knowledge of your Personal Info (PI) which holds your;

name,
parentage and date of birth,
gender and marital status,
nationality, state/city of residence, residential address, e-mail address,
contact number/mobile number, user ids, passwords,
recent photograph, signature image,
income proof, PAN, credit score, credit information report, e-KYC through UIDAI, Aadhaar based e-Sign and such other Know Your Customer (KYC) documents like address proof, identity proof, officially valid documents/details (OVDs) accepted for concluding a financial transaction)

And this may be shared/ uploaded by you, as and when you avail any products and/or service through usage of the Website of WayToCredit.

(ii) By visiting and/or using our Website, you agree to this Policy. Further, this policy applies to all current and former visitors to the Website. We firmly recommend to you to return to this page occasionally to review so that you’ll be updated with the most current version of the Policy.

(iii) WayToCredit reserves the right at any time, at its exclusive discretion, to change or otherwise modify the Policy without prior notice, and your continued access or use of this Website signifies your acceptance of the updated or current Policy. However, If there is any material change to the Policy, you’ll be made aware of with an e-mail notification through a warning notice on this Website just before the changes are done.

3. EXPRESS CONSENT:

i) Attention to all the customers, while providing your details/documents over the Website, please explicitly specify to WayToCredit (including its marketing channels and business partners) to contact you through any electronic media (SMS, call, or e-mail) to follow up calls concerning the services provided through the Website.

(ii) The website requires you to provide consent for keying in/ uploading your PI (including but not limited to user ids and passwords)because it could become necessary to process your application through the Website and for your usage of the website.

And it is required for enabling;

convenient,
faster and
electronic documentation (paperless processing) of applications for financial products opted/ availed by you.

iii) You hereby authorize and explicitly consent us to share your PI with third parties including but not limited to Credit Information Companies (“CIC”) to do an aggregate check of your credit profile for WayToCredit to send you targeted communications and offers.

(iv) If you are no longer interested in sharing your PI, please e-mail your request at info@waytocredit.com. Please note that it may take about 72 business hours to process your request. In furtherance to your usage of the Website, you expressly waive the Do Not Call (DNC) / Do Not Disturb (DND) registrations on your phone/mobile numbers for contacting you for such purpose and usage. Hence, there will be no DNC / DND check required for the number you may have left on our Website. Such modes of contacting you may include sending SMSs and/ or telephonic calls.

(v) WayToCredit reserves the right (and you expressly authorize WayToCredit) to share or disclose your PI when WayToCredit determines, in its sole discretion, that the disclosure of such information is necessary or appropriate under the law for the time being in force.

4. CREDIT INFORMATION REPORT

i) Only if you stay in harmony with WayToCredit and appoint it as your lawfully appointed authorized agent/ representative for collecting your credit information from CICs WayToCredit gets this information from CIC for and on your behalf.

By consenting to use and avail your credit information report through WayToCredit, you agree that WayToCredit and CICs shall be entitled to rely on your authorization and consent granted by you to WayToCredit.

(ii) Availing your credit information through WayToCredit is subject to your passing of appropriate identity authentication for security and privacy purposes. WayToCredit shall not notify you of the reasons if you are unable to pass such identity authentications and not able to view and/or use your credit information.

(iii) WayToCredit may analyze and profile your credit information to assist you in being better informed about, understand and manage your credit score/rating, identify and inform you of credit products that are likely to be suited to your circumstances, to identify whether you may benefit from additional guidance concerning your credit score and steps you can take to improve your score and credit history, etc.

5. MUTUAL FUNDS:

(i) WayToCredit collects, receives, possesses, stores, deals or handles PI received from our investors/client/customers whether existing users or prospective potential customers. A typical PI includes the following:

Bank Account details, change of bank account details or registration of multiple bank accounts, etc. through application forms;
Means of payment details at the time of applying at the time of investment or as proof for carrying out a change of bank account or any other details of debit card obtained (if any);
Generation and storing password (PIN) in encrypted form based on the request from the investor under the online mode of investments;
Demographic/ Biometric information obtained if any;
Demat Account details like beneficiary account no. etc.;
Annual Income and savings profile; and
Any other information as may be considered as PI.

(ii) The aforesaid information is being collected by WayToCredit

to respond to your requests,
to process the investment applications and
to also ensure safe subscriptions/redemptions of mutual fund investments.

WayToCredit may also call you to inform them concerning the other products or services offered by its partner AMCs. The said information is also being collected to be compliant with the “Know Your Client” (KYC) norms under the “Prevention of Money Laundering Act”, 2002 (PMLA), the rules issued thereunder, and guidelines and circular on Anti- Money Laundering issued by SEBI and SEBI (Mutual Funds) Regulations, 1996 as amended till date.

6. PURPOSE AND USAGE:

(i) WayToCredit will not sell or rent your PI to anyone, for any reason, at any time. However, we will be sharing your PI with our affiliates and business partners including CICs, where we feel that you will be assisted better,

for underwriting and approval of your credit card loan or any other financial product transaction/related transaction;
or for doing a check of your credit profile on your behalf and sending you targeted communications and offers.

If legally it is required to process any specific types of information, in such circumstances, we assure you that WayToCredit won’t process it without your concern. WayToCredit uses the PI collected to manage its business and offer you an enhanced, personalized online experience on its Website. By registering on the Website, you authorize WayToCredit to send SMS and e-mail alerts to you for its service requirements, including sending promotional e-mails and SMSs.

Further, it enables WayToCredit to:

send you any administrative notices, offer alerts and other communications relevant to your use of the Service;
display tailored product offers to you and enables you to apply for certain products and services for which you have chosen to apply;
carry market research, project planning, troubleshooting issues, detecting and protecting against error, fraud or other criminal activity;
improve our Services and manage our customer relationships better;
enforce WayToCredit General Terms of Use;
comply with all applicable laws and regulations.

(ii) If you access the Service as brought to you by one of our partners either through the Website or on being redirected from a co-branded URL or any other website, your name, e-mail address, mobile number, date of birth, employment type, residency status, income details/proofs, Form 26 AS, PAN, details of loan/credit card/ mutual fund applied for and loan, credit card and mutual fund status or any other financial product status may be provided to that partner when your application is submitted and whenever the status of application is updated. WayToCredit has a business relationship with these partners and you may not opt-out of sharing your information with these partners if you have applied via a co-branded URL or any other website or directly through the Website as the case may be.

(iii) For availing the Service such as applying for credit information report, loan, credit card, mutual fund or any other financial product we will require you to provide/upload on the Website the details such as your name, parentage, marital status, email address, nationality, location, mobile number, PAN, employment & income details/proofs, Form 26 AS, recent photograph, signature image, other “Know Your Customer” (KYC) documents like address proof, identity proof and personally-identifying information about a potential co-loan applicant (should you select this option), and to participate on our forum boards, you must provide a username for yourself.

(iv) You may opt-out of location-based services at any time by editing the setting of your browser.

(v) To provide your bank statement or payslip electronically along with your loan application, you also must provide your third-party account credentials (“Account Credentials“) to allow WayToCredit to retrieve your account data at those other financial institutions (“Account Information“) for your use. Your Account Credentials are only used once to retrieve your bank statements/payslips, Form 26 AS and are not stored in our system. WayToCredit shall not be liable to you against any liability or claims which may arise out of such transactions being carried on your own accord.

7. INTIMATION BY CUSTOMERS REGARDING CHANGE IN PERSONAL INFORMATION:

(i) If your PI provided to us when you had applied for a product on our Website changes, you may update it whenever you apply for a new product via our Website. To review and update your PI and to ensure that the same is accurate while your application is in process, you may contact us at. You will not be able to update the information you have provided in an application after a decision has already been made on it; however, you may create and submit a new application with your updated information.

(ii) Note: We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services, contact us at info@waytocredit.com. We will respond to your request within a reasonable timeframe.

8. RETENTION OF YOUR DATA

(i) WayToCredit will retain your information for as long as it is necessary for providing you the Services available on the Website or your request for termination of your account with WayToCredit, whichever is later.

(ii) Post-termination of your account, WayToCredit may continue to use your anonymized data aggregated or in combination with anonymized data of other users. We use this aggregated anonymized data for data analysis, profiling and research purposes, for example, to gain insights about our users and their profiles. We may keep your contact information along with your application details (if any) for fraud prevention purposes and the exercise/ defense of a legal claim or for providing evidence in a legal proceeding(s).

(iii)We keep your data secure, we follow generally accepted standards to protect the PI submitted to us, both during transmission and once we receive it. Since no method of transmission over the Internet, or method of electronic storage, is 100% secure, therefore, we cannot guarantee its absolute security. 9. LOG FILES:

This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. 10. THIRD PARTIES WILL NOT BE GIVEN YOUR PERSONAL INFORMATION UNLESS YOU GIVE CONSENT TO WAYTOCREDIT:

credit information reports,
loans,
credit cards,
mutual funds, and
other financial products

These are being offered by third parties on our Website, such as lenders, banks, credit card issuers and mutual funds (collectively “Offers“).

If you choose to apply for these separate products or services, disclose information to the providers, or permit them to collect information about you, then their use of your information is governed by their privacy policies. You should evaluate the practices of these external service providers before deciding to use their services.

WayToCredit is not responsible for their privacy practices.

(ii) If you use a blog, comments section or any other public forum on the Website, any information you submit there can be read, collected or used by other users and could be used to send you messages. WayToCredit shall not be held responsible for the PI you choose to submit in these forums.

11. TESTIMONIALS, BLOGS AND OTHER FORUMS ON WAYTOCREDIT WEBSITE:

12. YOU ARE RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR LOGIN ID AND PASSWORD:

(i) You are responsible for maintaining the security of your login ID and Password and must not provide these credentials to any third party. If you believe that they have been stolen or been made known to others, you must contact us immediately at info@waytocredit.com. We are not responsible if someone else accesses your account through the login credential they have obtained from you or through a violation by you of this Privacy and Security Policy or the WayToCredit Terms of Use.
